New regulations to protect safety and health in the homework environment

On Friday, November 14, 2025, the deadline expired for individuals employing domestic staff to carry out a risk assessment and inform their employees.

This group, made up mostly of women, now gains access to such fundamental rights as workplace health protection, from which they were previously excluded.

On September 11, 2024, Royal Decree 893/2024 of September 10 was published, regulating safety and health protection in the domestic service sector. The regulation came into force six months after its publication, on September 11, 2024.

This regulation, which has been applied for many years in all companies, aims to guarantee workers’ right to effective protection regarding workplace safety and health, particularly in preventing violence against women, while considering the specific characteristics of domestic work.


1. Right to effective and free protection

Domestic workers are entitled to effective workplace protection. Costs for safety measures cannot be passed on to employees.


2. Risk assessment and preventive measures

Employers must carry out an initial risk assessment, update it regularly, and adopt appropriate safety measures.

3. Work equipment and personal protective gear

Provide suitable work equipment and, where necessary, personal protective equipment according to the risk assessment.


4. Information, participation, and training

Employers must inform about risks and protective measures, consider employees’ suggestions, and offer training.


5. Interruption of activity in case of danger

In the event of serious and imminent danger to life or health, work may be interrupted without negative consequences.
The employer must be informed immediately!


6. Organization of preventive activity

Options:
• Employer assumes responsibility directly
• A qualified person is appointed
• An external prevention service is hired


7. Health monitoring

Right to voluntary medical check-ups at least every three years.


8. Home care services

Companies must assess risks and obtain the homeowner’s consent for preventive measures.


9. Training in prevention

Free training upon hiring, funded by the State Employment Service and delivered by the Employment Training Foundation.


10. Protection against violence and harassment

INSST will develop a protocol to prevent violence and harassment in the domestic work environment.


11. Future legal developments

Planned: protection at the same level as any other employment relationship.

Document-related obligations
Availability: Must be kept at home to present to the labor authority upon request.
Updating: Adjust according to established deadlines to correct deficiencies in prevention.
Penalties: Failure to carry out the assessment or update it when working conditions change may result in fines (amount not yet defined).
